1. Acceptance of Terms

By accessing or using Folio at joinfolio.io ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Folio is an AI-powered creative opportunity engine for photographers, videographers, and music producers. The Service connects your communication channels (e.g. Instagram DMs) with your creative asset library to help you respond to incoming opportunities efficiently.

3. Eligibility

You must be at least 13 years old to use the Service. By using Folio, you represent that you meet this requirement and that all information you provide is accurate and complete.

4. Account Responsibilities

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • You must notify us immediately of any unauthorized use of your account.
  • You may not share your account with others or transfer it to another person.

5. Third-Party Integrations

Folio connects to third-party services (Instagram, Google, Dropbox, etc.) on your behalf. By connecting these integrations, you authorize Folio to access and store data from those services as described in our Privacy Policy. You remain responsible for complying with the terms of those third-party platforms.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Upload malicious code or interfere with the Service's operation
  • Use the Service to send spam or unsolicited communications
  • Reverse engineer or attempt to extract the source code of the Service
  • Violate any applicable laws or third-party platform policies

7. Intellectual Property

The Folio platform, including its design, code, and branding, is owned by Folio and protected by applicable intellectual property laws. Your content (assets, messages, and data) remains yours. You grant Folio a limited license to process your content solely for the purpose of providing the Service.

8. Disclaimers

The Service is provided "as is" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. AI-generated content and classifications are provided for assistance only and may not always be accurate.

9. Limitation of Liability

To the maximum extent permitted by law, Folio shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

10. Termination

We reserve the right to suspend or terminate your access to the Service at our discretion, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may terminate your account at any time by contacting us at hello@joinfolio.io.

11. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the new Terms. We will update the "Last updated" date at the top of this page when changes are made.

12. Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law principles.
